When renting an apartment in Japan, carefully reading the contract is more important than anything else. Rental agreements are full of technical jargon, and with the real estate agent rattling off explanations, plenty of people get swept up in the moment and sign on the spot. But putting your seal to a document you don't fully understand can lead to serious trouble down the line.
Along with the contract, you will always receive a juyo jiko setsumeisho (Important Matters Explanation Document). This is the material a licensed real estate transaction specialist uses to walk you through the property's conditions and contract terms verbally, and its delivery is required by the Real Estate Transaction Business Act. If anything is unclear after the explanation, you should ask right then and there without hesitation. Unless you ask, you cannot really sign with peace of mind.
The first thing to check is the breakdown of move-in costs. Beyond the rent itself, you'll typically pay shikikin (security deposit), reikin (key money), an agent's fee, fire insurance, lock replacement, and a guarantor company fee — together these can easily reach four or five months' rent. For a unit renting at 80,000 yen, the move-in cost can exceed 300,000 yen. The shikikin is a deposit that may be partially returned when you move out, but the reikin is a gratuity to the landlord and, as a rule, never comes back.
Next, pay close attention to the clauses on contract length and renewal. Standard "ordinary lease" contracts in Japan usually run for two years, and there are still many properties that charge a renewal fee of roughly one month's rent. With a "fixed-term lease," the contract simply ends when the term expires, and if you want to stay you have no choice but to negotiate a brand-new agreement with the landlord — so confirming which type you're signing is critical from the start.
When it comes to moving out, the notice period is spelled out in the contract. Typically you must give written notice at least one month before your intended move-out date, and failing to do so risks a penalty equivalent to one month's rent. Furthermore, some contracts add a short-term cancellation penalty of one to two months' rent if you leave within one or two years of moving in, so anyone who might be transferred for work should read this section especially carefully.
The clause on genjo kaifuku (restoring the unit to its original condition) is where the most disputes arise. Under the Ministry of Land, Infrastructure, Transport and Tourism's guidelines, ordinary wear such as wallpaper fading from sunlight or floor dents from furniture should not be charged to the tenant. Despite that, many contracts contain special clauses saying things like "the tenant pays for end-of-lease house cleaning" or "tatami mat refacing is at the tenant's expense" — and once you sign, you have to comply. Taking photos of any existing scratches or stains at move-in and sharing them with the agency goes a long way toward preventing unfair charges later.
Guarantor arrangements have also shifted. Rather than requiring a personal rentai hoshonin (joint guarantor), more and more properties now insist that you use a hosho-gaisha (guarantor company). With a guarantor company you usually pay half a month to one month's rent upfront, plus around 10,000 yen each year as a renewal fee. Even if you have a family member who would willingly co-sign, some landlords' policies make the guarantor company unavoidable.
Other house rules — keeping pets, playing musical instruments, adding a roommate, subletting — are also spelled out in the contract. Violations can give the landlord grounds to demand termination, so if you plan to keep a pet or let a friend stay for an extended period, check in advance without fail. Brushing it off with "I'll just ask later" can backfire and lead to being told to move out.
The most important thing when reading a contract is to never let an unclear point slide. Once you sign, "I didn't know" no longer works as an excuse. As tedious as it feels, asking questions until you are genuinely satisfied and only then signing is, I believe, the surest shortcut to starting your new life with peace of mind.
